Dear Mr. President,
On the occasion of your pending visit to Vietnam, we, the undersigned organizations, respectfully submit the following recommendations:
- We believe that successful partnership requires accountability and mutual benefits. Vietnam authorities need to show that they will be accountable for serious violations of human rights. We also believe that an alleged agreement that will boost Vietnam’s efforts to develop semiconductor and artificial intelligence is a mistake. AI, in the hands of an unchecked totalitarian system, is a tool for control and censorship of our people. On the other hand, any export of semiconductor technology to Vietnam is possibly destined to China to evade the ban on Chinese chip procurement.
- We recommend that the US, through its State Department, publicize and enforce the Global Magnitsky Human Rights Accountability Act in its dealings with the Vietnamese authorities. This legislation should also be translated into Vietnamese and posted prominently on U.S. embassy website and Facebook page.
- The US should not implicitly recognize that Vietnamese elections are free and fair. Elections in Vietnam are not meeting any of the international standards, getting only a 27/100 on a Free and Fair Election Score based on international conventions.
The issue of free and fair elections is a matter of great importance to the Vietnamese people, inside and outside the country. We ask that the US promote verifiable free and fair elections in Vietnam as a partner in our free and open Indo-Pacific initiative.
- We ask that you address Vietnam’s human rights situation, especially the plight of those detained for their religious, human rights and democracy advocacy. Specifically, the US should voice its support for freedom of expression and independent labor unions in Vietnam, as conditions for diplomatic upgrade of bilateral relationship.

Thưa Tổng Thống,
Chuyến công du Việt Nam sắp đến của Tổng Thống, chúng tôi, các tổ chức ký tên dưới đây, xin trân trọng đệ trình các khuyến nghị sau:
- Chúng tôi tin rằng một mối quan hệ song phương muốn thành công đòi hỏi trách nhiệm và lợi ích chung. Nhà cầm quyền Việt Nam cần chứng tỏ rằng họ phải chịu trách nhiệm cho những vi phạm nhân quyền nghiêm trọng. Chúng tôi cũng cho rằng một thỏa thuận để thúc đẩy nỗ lực của Việt Nam phát triển chất bán dẫn và trí tuệ nhân tạo là một sai lầm. AI trong tay của một thể chế toàn trị là một công cụ để đàn áp và kiểm duyệt người dân. Mặt khác, bất kỳ hoạt động xuất khẩu công nghệ bán dẫn nào sang Việt Nam đều sẽ có thể được gửi qua Trung Cộng với mục đích trốn tránh lệnh cấm bán chip.
- Chúng tôi khuyến nghị Hoa Kỳ, thông qua Bộ Ngoại giao, công khai áp dụng Đạo luật Trách nhiệm Giải trình Nhân quyền Magnitsky Toàn cầu trong các quan hệ với nhà cầm quyền Việt Nam. Luật này cũng nên được dịch sang tiếng Việt và đăng nổi bật trên trang web và trang Facebook của Đại sứ quán Hoa Kỳ.
- Mỹ không nên mặc nhiên công nhận bầu cử ở Việt Nam là tự do và công bằng. Các cuộc bầu cử ở Việt Nam không đáp ứng bất kỳ tiêu chuẩn quốc tế nào, chỉ đạt 27/100 trên Thang điểm Bầu cử Tự do và Công bằng dựa trên các tiêu chí được quốc tế chấp nhận. Vấn đề bầu cử tự do và công bằng là vấn đề hết sức quan trọng đối với người dân Việt Nam trong và ngoài nước. Chúng tôi yêu cầu Hoa Kỳ thúc đẩy các cuộc bầu cử tự do và công bằng có thể kiểm chứng được ở Việt Nam trên tư cách là một đối tác trong kế hoạch một Ấn Độ Dương – Thái Bình Dương tự do và cởi mở.
- Chúng tôi yêu cầu Tổng Thống thảo luận tình hình nhân quyền ở Việt Nam, đặc biệt là hoàn cảnh của những người bị giam giữ vì lý do tôn giáo, nhân quyền và vận động dân chủ. Cụ thể, Mỹ nên lên tiếng ủng hộ quyền tự do ngôn luận và các liên đoàn lao động độc lập ở Việt Nam, coi đó là điều kiện để nâng cấp quan hệ song phương về mặt ngoại giao.
